New Horizon Employment - TERMS OF AGREEMENT
TERMS OF AGREEMENT BETWEEN NEW HORIZON EMPLOYMENT LIMITED AND WORKER
- DEFINITIONS
In the Terms of Engagement the following definitions apply: -
"Assignment" - means "A period during which the Temporary Worker is
supplied to render services for the Clients"
"Client" - means "The person, firm or corporate body requiring
The services of the Temporary Worker"
1 .2. Unless the context otherwise requires, references to the masculine including the feminine and Vice Versa.
1.3. The headings contained in these Terms are for convenience
only and do not affect the interpretation. - THE CONTRACT
2.1 These Terms consist of a contract for services between the New Horizon Employment Limited and the Temporary Worker which govern all Assignments undertaken by the Temporary Worker. However, no contract shall exist between the Employment Limited and the Temporary Worker between Assignments.
2.2. The Temporary Worker is engaged as a self-employed worker, although the New Horizon Employment Limited is required to make statutory delusions from his remuneration in accordance with clause 4.1.
2.3. No variation or alternation of these Terms shall be valid unless approved by the New Horizon Employment Limited in hand writing. - ASSIGNMENT
3.1. The New Horizon Employment Limited will Endeavour to obtain suitable Assignments for the Temporary Worker to work as see above category.
3.2. The Temporary Worker acknowledges that the nature of the temporary work means that there may be periods when no suitable work is available and agrees that suitability shall be determined solely by the New Horizon Employment Limited'. The New Horizon Employment Limited shall incur no liability to the Temporary Worker should it fail to offer opportunities to work as see above categories.
3.3. For the purpose of calculating the average number of weekly hours worked by the Temporary Worker on an Assignment the start date for the relevant averaging period under the Working Time Regulations Act May 1998 or the date on which the Temporary Worker commences the first Assignment, if later.
3.4. If the Temporary Worker will accept an Assignment, They shall comply and be present during and at all times when services are due to a Client * 3.5. The Temporary Worker agrees that if during the course of an Assignment he fails to attend or leaves an Assignment without prior notification for any reason, the New Horizon Employment Limited may be obliged to charge the Temporal Worker an additional fee, covering its possible losses due to a Client.
3.6. The Temporary Worker agrees that, if the Client wishes to employ the Temporary Worker on a permanent basis (or where the Temporary Worker is introduced to a third party). the New Horizon Employment Limited is entitled to charge a fee or offer the Client an extended period of hire for the services of the Temporary Worker. - REMUNERATION
4.1. The New Horizon Employment Limited shall pay to the Temporary Worker remuneration calculated at minimum hourly rate stated. The actual rate will be notified on a or Assignment basis, for each hour worked during an Assignment (to nearest quarter hour) to be paid weekly in arrear, subbed to deductions in reaped of PAYE Class I National Insurance Contributions and income Tax pursuant to SIM of the Income and Corporation Taxes Act 1998 and any other delusions which the New Horizon Employment Limited may be required by law to make.
4.2. The Temporary Worker is not entitled to receive payment from the New Horizon Employment Limited or Clients for the time not spent on Assignment, whether it is reaped of holidays, illness or absence for any other reason unless otherwise agreed. - STATUTORY LEAVE
5.1. For the purpose of calculating entitlement to leave under the clause. the leave year commences 1st of January and ends 31st of December.
5.2. In the course of any Assignment during the first work year, the Temporary Worker if wishes to take any holiday, should notify the New Horizon Employment Limited in writing of the dates of leave.
5.3. The Temporary Workers basic hourly rate of pay includes an additional sum by way of rolled-up holiday pay based on hourly rate to be paid on a weekly basis. In this way, the Temporary Worker is paid for holiday in advance. The New Horizon Employment Limited sets off any such payment made in advance against any entitlement to paid which arises either during the course of, or on termination, of the Assignment. For the avoidance of doubt, the Temporary Worker will receive no further payment during any holiday period, in lieu of intakes holiday or the termination of the relevant Assignment, it being acknowledged and agreed that the worker has received full holiday pay in advance.
5.4. The right to paid holiday accuses in promotion to the amount of time worked continually by the Temporary Worker on the relevant Assignment during the holiday year. - MAXIMUM WORKING WEEK
6.1. The Working Time Regulations Act 1998 provide that the Temporary Worker shall not work in excess of the working week unless He or she agrees in writing that this limit should not apply.
6.2. The Temporary Worker hereby agrees that the above mentioned working week limit shall not apply to any Assignment arrested by the Temporary Worker. - TIME SHEETS
7.1. At the end of the week of an Assignment (This is a period of one week or less and is to be completed on a weekly basis before the end of a week), the Temporary Worker shall deliver to the New Horizon Employment Limited their time sheet duly completed to indicate the number of hours worked by him during the week and signed by an authorized representative of the Client. Failure to submit a time sheet for hours worked may delay payment for those hours. - TERMINATION
8.1. The New Horizon Employment Limited or the Client may, without prior notice or liability, request the Temporary Worker to end an Assignment at any time.
8.2. The Temporary Worker may terminate employment at any time by informing the New Horizon Employment Limited.
8.3. lf the Temporary Worker does not report to the New Horizon Employment Limited to notify their availability for their work for a period of three weeks, the New Horizon (Employment Limited) will forward their pay to their last known address. - LAW
9.1. These Terms are Governed by the law of England & Wales and are subbed to the exclusive jurisdiction of the Coups of England & Wales.
